Marijuana Positions

  • Taxation

    • The sale of marijuana is subject to taxation.
    • The City Council voted in January to reduce the tax on recreational marijuana to 3%, to comply with state law, and to reduce the tax on medical marijuana to 3%.

    Medical marijuana in Gresham

    • Personal medical marijuana grows: Allowed in Gresham, subject to state law, and the Gresham City Code. The City’s definition of a personal medical grow is growing up to six medical marijuana plants where a patient lives.
    • Growing medical marijuana for non-personal use: Prohibited in residential and commercial districts. Not prohibited within industrial zones but subject to local regulation and a City registration process. Available locations are limited.
    • Medical marijuana dispensaries: Are not prohibited, but are subject to local regulation and a City registration process. Available locations are limited.
    • Inspections: Dispensaries and grow operations in the city of Gresham are subject to City inspection.
    • Buffer: A buffer of 1,000 feet is in effect between certain uses and medical marijuana businesses. The buffer applies to schools, parks, religious institutions, and state-licensed child care facilities.

    Recreational marijuana

    • Homegrown recreational marijuana, as authorized under Measure 91 on July 1, 2015, is subject to state law but not regulated by the City.
    • The City Council voted on Jan. 16 to allow recreational marijuana businesses and grows in the city, subject to similar regulations for medical marijuana businesses and grows.
    • Voters may file an initiative petition for a local option election to prohibit recreational marijuana retailers.
